1. Directory Service Only

Rialto Home Services ("we," "us," or "our") operates solely as an online directory and referral service that connects homeowners with independent home service professionals ("Service Providers"). We do not employ, supervise, or control any Service Provider listed in our directory.

We are not a contractor, subcontractor, or home service provider. We do not perform any home services, repairs, installations, or any other work. Our role is limited to providing a platform where users can discover and contact local service providers.

2. No Guarantees or Warranties

WE MAKE NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES of any kind, express or implied, regarding:

• The quality, safety, or legality of any services provided by Service Providers
• The qualifications, licensing, insurance, or credentials of any Service Provider
• The accuracy or completeness of any information provided by Service Providers
• The timeliness, reliability, or performance of any Service Provider
• The outcome or results of any work performed by Service Providers
• Any representations made by Service Providers regarding their services

While we may display information about Service Providers' licenses, insurance, or certifications, we do not independently verify this information. Users are solely responsible for verifying the credentials, qualifications, and suitability of any Service Provider before hiring them.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RIALTO HOME SERVICES AND ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Property damage, personal injury, or death
• Loss of profits, data, business, or goodwill
• Damages arising from the acts, omissions, or negligence of any Service Provider
• Damages arising from disputes between users and Service Providers
• Damages arising from any services performed or not performed by Service Providers
• Any other damages of any kind arising from or related to your use of our service

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

4. User Responsibilities

By using our service, you agree that you are solely responsible for:

• Independently verifying the credentials, licenses, insurance, and qualifications of any Service Provider
• Conducting your own due diligence before hiring any Service Provider
• Negotiating and agreeing to terms, pricing, and scope of work directly with Service Providers
• Ensuring any work performed complies with local building codes and regulations
• Obtaining necessary permits for any work that requires them
• Any contracts, agreements, or disputes with Service Providers
• Any damages, injuries, or losses resulting from services provided by Service Providers

5. Indemnification

You agree to indemnify, defend, and hold harmless Rialto Home Services and its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of our service
• Your interactions with any Service Provider
• Any services performed or not performed by Service Providers you contacted through our service
• Your violation of these Terms of Service
• Your violation of any applicable law or regulation

6. Service Provider Terms

Service Providers listed in our directory are independent businesses and are not employees, agents, or representatives of Rialto Home Services. By listing their business in our directory, Service Providers agree that:

• All information provided is accurate and not misleading
• They maintain all required licenses, permits, and insurance for their trade
• They are solely responsible for the quality and safety of their work
• They will comply with all applicable laws and regulations
• They indemnify Rialto Home Services against any claims arising from their services

7. No Endorsement

Listing a Service Provider in our directory does not constitute an endorsement, recommendation, or guarantee of that Service Provider. "Featured" listings are paid placements and do not indicate superior quality, reliability, or our recommendation of that Service Provider over others.

8. Dispute Resolution

Any disputes between you and a Service Provider must be resolved directly between you and the Service Provider. We are not a party to any agreement between you and any Service Provider and have no obligation to mediate or resolve any such disputes.

Any disputes arising from these Terms of Service or your use of our service shall be governed by the laws of the State of California and shall be resolved in the courts of San Bernardino County, California.

9. Privacy

By using our service, you consent to the collection and use of information as described in our Privacy Policy. Information you provide (such as contact details in quote requests) may be shared with Service Providers to facilitate their response to your inquiry.

10. Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of our service after any changes constitutes acceptance of the modified terms.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
